    O Direito e a Ética disciplinam as relações humanas por meio de normas que mudam de conformidade com o nível cultural de cada povo.

    Entende-se por Ética o conjunto de valores, de princípios universais que regem as relações das pessoas do ponto de vista do bem e do mal. A ética do bem pode ser comparada com uma espécie de cimento de sustentação da sociedade. Quando existe um sentimento ético igualitário, a sociedade mantém-se harmonizada. Quando esse sustentáculo rompe-se, a vida comunitária entra em crise autodestrutiva.

    As normas éticas são cumpridas de acordo com a convicção e a liberalidade de cada um, diferentemente das normas jurídicas, são impostas e ninguém pode negar que as desconhece para isentar-se da pena. Em outras palavras, o Direito determina obediência à lei. Se essa não é observada, haverá sanções, razão por que deve ser breve e compreensível.

    Apesar disso, certas leis são injustas, porque privilegiam o interesse do mais forte, convertendo-se em instrumento de opressão. A propósito, assim se expressou Sólon (político grego, 640-560 a.C.): “As leis são como teias de aranha; quando algo leve cai nelas, fica retido, ao passo que se for algo maior, consegue rompê-las e escapar”.

    O fato é que uma lei pode ser moralmente falível. É preciso, pois, que haja responsabilidade na sua aplicação. Merece repúdio todo e qualquer ato tendente a manipular a norma jurídica com a finalidade de beneficiar alguém. Nesse sentido, nada é mais perigoso do que a máxima que declara necessário consultar o espírito da lei, gerando um caos de opiniões. Seria absurdo se as leis que abominam e punem as condutas criminosas cometessem as iguais lesividades.

    As nações mais evoluídas adquiriram a habilidade de interpretar a lei com equidade e justiça, e vão além da mera literalidade da norma, avançando para os altos níveis das possibilidades humanas. Nada é mais perigoso que a subserviência à letra morta da lei. Sempre que a vida é concebida por um escravismo legalista, a ética torna-se medíocre e a balança da Justiça inclina-se para o lado dos privilégios e da arbitrariedade.

    RESUMO

    A Constituição da República de 1988, em seu artigo 133, consagra a advocacia como profissão indispensável à administração da justiça, sendo a única atividade profissional com expresso reconhecimento constitucional. Exatamente pela importância do profissional da advocacia é que seu agir deve se pautar na ética. A Ordem dos Advogados do Brasil, para nortear a atuação dos profissionais devidamente habilitados, editou o Código de Ética, que prevê os deveres éticos do advogado e as respectivas punições para eventuais infrações. Este estudo tem por objetivo analisar a atuação do profissional do Direito, em especial o advogado. O método adotado é o exploratório e a pesquisa se pauta na revisão bibliográfica. Apresenta os aspectos históricos e conceituais relativos à atividade da advocacia. Aborda as prerrogativas constitucionais do advogado. Verifica o conceito de ética na atualidade, destacando a relevância da ética na profissão. Ao final aborda a crise ética na advocacia. Metodologicamente a pesquisa classifica-se como qualitativa, descritiva, exploratória e bibliográfica. Constatou-se que a ética, na atualidade, refere-se aos princípios que guiam o comportamento moral individual e coletivo, influenciando escolhas entre o bem e o mal. Na advocacia, a ética é essencial, exigindo o compromisso das entidades profissionais e da sociedade em fiscalizar a conduta dos advogados, tanto em assuntos públicos quanto privados. Isso assegura a proteção dos direitos e contribui para uma sociedade mais justa, ética, democrática e livre.

    ABSTRACT

    The 1988 Constitution of the Republic, in its article 133, enshrines advocacy as a profession essential to the administration of justice, being the only professional activity with explicit constitutional recognition. It is precisely because of the importance of the legal professional that their actions should be guided by ethics. The Brazilian Bar Association, in order to guide the conduct of duly qualified professionals, has issued the Code of Ethics, which outlines the ethical duties of the lawyer and the respective penalties for any infractions. This study aims to analyze the role of legal professionals, especially lawyers. The adopted method is exploratory, and the research is based on bibliographic review. It presents the historical and conceptual aspects related to the practice of law. It addresses the constitutional prerogatives of the lawyer. It examines the concept of ethics in contemporary society, emphasizing its relevance in the profession. Finally, it discusses the ethical crisis in advocacy. Methodologically, the research is classified as qualitative, descriptive, exploratory, and bibliographic. It was observed that ethics in contemporary society refers to the principles that guide individual and collective moral behavior.

    Qual a diferença entre o Estatuto da OAB e Código de Ética?

    O Estatuto da OAB é um dos alicerces da advocacia. Isso porque é o instrumento legal que, entre outras coisas, regulamenta a atividade da advocacia, prevê os direitos do advogado, os requisitos para se tornar um e, até mesmo, quais infrações pode vir a cometer e as respectivas sanções disciplinares possíveis de serem aplicadas. Ou seja, o estatuto OAB precisa ser conhecido por todo aquele que se dedica à advocacia. É por isso que nós decidimos dedicar o presente texto ao tema!     O estatuto da OAB é uma lei que dispõe sobre a atividade da advocacia, a organização e estrutura da Ordem dos Advogados do Brasil (OAB) e sobre o processo disciplinar no âmbito da instituição. Portanto, se um advogado quer saber seus direitos, como funciona a estrutura de determinado órgão dentro da OAB ou se praticou alguma infração disciplinar passível de punição, ele deve consultar o estatuto da advocacia. É lá que ele encontrará a resposta para todas as suas dúvidas. Além disso, o estatuto da OAB foi promulgado pela Lei n.º 8.906 de 4 de julho de 1994, pelo então presidente Itamar Franco. Ou seja, aqui falamos de uma Lei.

    É muito comum que surjam dúvidas sobre a diferença entre o Estatuto da OAB e o Código de Ética e Disciplina da OAB. E de fato, ambos os instrumentos legais não são a mesma coisa. O Estatuto da Advocacia é constituído pela Lei n.º 8.906/1994 e em seus arts. 33 e 54, V, prevê a existência do Código de Ética e Disciplina da OAB, dando a competência para sua confecção ao Conselho Federal da OAB. De modo que o Estatuto da OAB é uma Lei Federal e o Código de Ética é uma norma interna da OAB. Já no que diz respeito aos temas abordados, ambos os institutos se confundem e se completam. Isso porque o Código de Ética em alguns momento repete e em outros momentos complementa o que está disposto no Estatuto da Advocacia. Entretanto, existem temas que são tratados somente no Código de Ética, como é o caso da Publicidade na Advocacia.

    Antes de mais nada, para que você realmente entenda uma norma, é preciso olhá-la de longe e depois de perto. Por isso, para que você tenha um panorama geral do estatuto OAB, vamos apresentar um sumário da norma, confira! Portanto, perceba que o Estatuto da OAB é dividido em três grandes partes, são elas:

    1. Normas que regulamentam a advocacia, os direitos dos advogados e questões relacionadas à inscrição, honorários, incompatibilidades e impedimentos.
    2. Normas que regulam a Ordem dos Advogados Internamente, isto é, a organização em si. De modo que as normas são destinadas a regulamentar a estrutura e o funcionamento do Conselho Federal, Conselho Seccional, as Subseções, a Caixa de Assistência dos Advogados e as Eleições e Mandatos.

    Onde encontrar o Código de Ética da OAB?

    O novo código de ética OAB foi aprovado em 2015 pelo Conselho Federal e entrou em vigor no ano seguinte. Isso aconteceu depois de duas décadas de vigência do antigo código de ética, o qual foi revogado para dar espaço a mudanças na advocacia. De fato, grande parte do antigo Código de Ética permanece inalterada, uma vez que não foi reconstruído desde o princípio. Contudo, em certos temas as mudanças foram expressivas.

    Isso pode ser visualizado na diferença de artigos, já que o antigo contava com 66, enquanto o novo código de ética OAB conta com 80 artigos. E é disso que iremos falar no presente texto, das mudanças trazidas pelo Novo Código de Ética da OAB! Vamos começar explicando o que é o Código de Ética e Disciplina!

    É um código que reúne regras que os advogados devem seguir ao exercer sua profissão. Sendo que, caso os causídicos violem essas regras, poderão sofrer punições disciplinares por parte da OAB. Portanto, é muito importante conhecer e dominar o novo Código de Ética da OAB.

    O código de ética da OAB é previsto na Lei n.º 8.906/ 1994, conhecida como Estatuto da Advocacia. Referida lei, em seu art. 54, V prevê que compete ao Conselho Federal da OAB editar e alterar o Código de Ética e Disciplina. Ou seja, a competência para criar ou alterar o Novo Código de Ética da OAB é do Conselho Federal da Advocacia.

    O novo código de ética da OAB é composto por 80 artigos, estes estão divididos em três títulos, os quais são subdivididos em capítulos e seções.
