    O Sistema Nacional de Defesa do Consumidor (Sindec), que integra os dados de centenas de Procons em todo o país, registrou em 2022 pouco mais de 1 milhão de atendimentos. Destes, 75% foram protocolos de denúncia ou reclamação. Esta última é o que tem potencial para gerar um processo administrativo no Procon.

    O processo administrativo conduzido pelo Procon é um dos meios que o órgão tem para apurar e buscar solução em conflitos envolvendo potenciais lesões aos direitos consumeristas. Contudo, não é o único procedimento possível, e não pode ser confundido com outras alternativas, como o envio de uma Carta de Informações Preliminares (CIP).

    O processo administrativo no Procon é um trâmite iniciado após o registro de uma reclamação individual, por parte de um consumidor, contra a prestadora ou fornecedora de um produto ou serviço. É por meio desse procedimento que o Procon pode agir, notificando e responsabilizando envolvidos e mediando conciliações, por exemplo.

    É importante entender, no entanto, que embora o processo administrativo seja um mecanismo para apurar e eventualmente aplicar sanções contra empresas que ferem o Direito do Consumidor, ele não é o mesmo que um processo judicial.

    O processo judicial tem andamento junto ao poder judiciário, se norteia pelo ordenamento jurídico brasileiro, e pode aplicar mais do que apenas sanções administrativas aos que forem considerados culpados.

    Já o processo administrativo é um trâmite mais simples, que não exige necessariamente a representação por um advogado, e que prevê punições limitadas à competência do Procon enquanto um órgão auxiliar do Poder Judiciário.

    O processo administrativo no Procon não é a primeira etapa de um atendimento no órgão. Ele é iniciado apenas quando outras medidas anteriores, de consulta e notificação da empresa, não surtem o efeito esperado.

    Na prática, o Procon de cada estado pode estabelecer procedimentos específicos para atender às demandas dos consumidores. Assim, as etapas anteriores, que antecedem a abertura do processo, podem variar em nomenclatura e procedimento. Resumimos as principais, abaixo. Confira.

    Muitos consumidores chegam ao Procon para tirar dúvidas, entender se estão enfrentando uma violação de seus direitos e aprender sobre quais medidas podem ser tomadas. Neste caso, os servidores do órgão costumam realizar o que é chamado de “consulta preliminar” ou “atendimento preliminar”.

    A consulta não necessariamente vai originar um processo administrativo ou sancionatório contra a empresa que é alvo de queixas. Afinal, antes, o órgão precisará avaliar o caso concreto trazido pelo consumidor e, eve.

    Qualquer pessoa física ou jurídica que tenha adquirido um produto ou serviço de uma empresa pode recorrer ao Procon.

    Primeiramente, encontre o Procon estadual ou municipal da região onde reside. É possível abrir uma reclamação comparecendo a uma unidade presencialmente, ou pela internet ou telefone.

    A maioria dos Procons hoje possui atendimento à distância ou eletrônico. Informe-se sobre os canais de contato e formulários para preenchimento da sua reclamação na página do Procon do seu Estado ou município.

    Do registro da reclamação à finalização, todo o procedimento é realizado de forma remota, não sendo necessário comparecer pessoalmente.

    Por se tratarem de órgãos estaduais ou municipais independentes, ligados à Secretaria Nacional de Defesa do Consumidor, cada Procon tem sua página, atividades e procedimentos próprios. Porém, todos eles se prestam a intermediar conflitos nas relações de consumo através de orientações, notificações, fiscalização, punição e outras iniciativas que visam buscar o cumprimento e o fortalecimento dos direitos estabelecidos pelo Código de Defesa do Consumidor.

    A Secretaria Adjunta de Proteção e Defesa dos Direitos do Consumidor (Procon-MT), da Secretaria de Assistência Social e Cidadania (Setasc), informa que o atendimento pelo WhatsApp (65) 99228-3098 foi restabelecido.

    O órgão disponibilizou também mais um número para atendimento pelo WhatsApp: (65) 3613-2100.

    Os serviços da ferramenta – que passou por instabilidade na quarta-feira (31.01) – podem ser utilizados normalmente. Pelo canal, os consumidores e fornecedores podem buscar informações, orientações e tirar dúvidas sobre direitos do consumidor. Também é possível registrar reclamação e denúncias.

    Além do atendimento pelo WhatsApp, o Procon-MT disponibiliza, ainda, outras formas de atendimento ao cidadão.
