    Com as fortes chuvas impactando boa parte do Brasil, milhões de pessoas sofrem sem energia elétrica. Muitas vezes, essa situação se dá por horas. Outras, por dias. Tem consumidor que fica até semanas sem energia.

    O Código de Defesa do Consumidor estabelece que a energia elétrica é um bem essencial à vida humana. Portanto, segundo o artigo 6º, inciso VI, os consumidores devem ter fornecimento adequado e contínuo, e as companhias são obrigadas a garantir a efetiva reparação pelos danos causados. Contudo, mesmo com a lei, as lacunas no fornecimento de energia são habituais e estão se tornando cada vez mais prolongadas. E, em muitos locais, em momentos como esses, os consumidores não conseguem acessar os canais de atendimento nem registrar reclamações.

    No Rio de Janeiro, por exemplo, munícipes da zona norte e oeste sem energia há dias, levaram colchões à praia para conseguir dormir. Em Porto Alegre e outras cidades do Rio Grande do Sul, depois de um temporal, milhões de pessoas ficaram sem energia elétrica – e assim permanecem, sem previsão de retorno. Indignados com a falta de transparência da CEEE-Equatorial, moradores de ao menos 10 bairros da capital gaúcha realizaram protestos exigindo que o reestabelecimento da energia. Em julho do ano passado, após a passagem de um ciclone pelo Estado, em algumas localidades, clientes ficaram até 15 dias sem luz.

    Além dos alimentos que estragam sem geladeira, com a súbita interrupção no fornecimento de energia elétrica, aparelhos eletrônicos e eletrodomésticos ficam suscetíveis a danos. Ademais, nessa época do ano, não são poucas as pessoas que não conseguem permanecer em suas casas devido ao calor, sem poder ligar o ventilador ou o ar-condicionado.

    Isso sem contar as pessoas que têm, nas casas, pacientes em regime de internação domiciliar e aquelas que precisam armazenar medicamentos como as insulinas, os hormônios, o soro fisiológico e alguns antibióticos, os quais requerem reconstituição. Nesses casos, consoante o Conselho Federal de Farmácia (CFF), a falta de refrigeração adequada pode alterar as estruturas físico-químicas do medicamento e, assim, comprometer a eficácia e a segurança.

    Na tentativa de evitar prejuízos às pessoas e às empresas, em São Paulo, a Enel criou um plano emergencial. Ela atende a 24 municípios da região metropolitana, incluindo a capital, fornecendo energia a 7 milhões de clientes em uma área que tem cerca de 1500 unidades consumidoras por km². A empresa está acionando seu plano de emergência sempre que há previsão de mau tempo, mantendo-se em plena mobilização durante todo o período.

    Assim foi no último fim de semana (de 19 a 21 de janeiro). No período, houve reforço das equipes operacionais e dos canais de atendimento para eventuais ocorrências que poderiam prejudicar o fornecimento de energia.

    O esquema do plano de emergência inclui a mobilização de até três vezes mais equipes em campo. Ademais, todos os canais de atendimento recebem reforço, abrangendo o call center, que tem a capacid

    Estou sem energia posso processar?

    De acordo com o Código de Defesa do Consumidor e com a Resolução 414/2010, da ANEEL, as concessionárias de energia elétrica podem, sim, ser responsabilizadas por prejuízos causados pela falta de energia ou descargas elétricas capazes de produzir danos em equipamentos.

    Registre seu pedido de ressarcimento na concessionária de energia

    Sempre que experimentar algum prejuízo em decorrência da falta de energia ou de alguma descarga elétrica, o consumidor deve, com a maior brevidade possível, procurar a empresa fornecedora de energia, relatando a ocorrência e pleiteando os ressarcimentos que entenda devidos.

    A solicitação de ressarcimento pode ser realizada por meio de atendimento telefônico, diretamente nos postos de atendimento presencial, via internet ou por outros canais de comunicação eventualmente oferecidos pela distribuidora, para essa finalidade.

    Atenção aos prazos e procedimentos

    Feito o pedido, com detalhes sobre os equipamentos danificados e demais prejuízos identificados, a empresa deverá promover o conserto ou a ressarcimento dos prejuízos dentro do prazo máximo de 90 dias, contados da data da sua ocorrência.

    É fundamental anotar os protocolos dos contatos realizados com a empresa, seguir as orientações recebidas e acompanhar os prazos estabelecidos.

    A empresa pode, por exemplo, efetuar vistoria nos aparelhos danificados, em até 10 dias a partir da data da solicitação. Para os equipamentos que acondicionam alimentos e medicamentos, no entanto, o prazo é de apenas 01 dia útil.

    Para auxiliar na investigação das causas do problema e na definição dos valores de ressarcimento, as concessionárias poderão solicitar que o consumidor envie até dois laudos e orçamentos de oficinas não credenciadas ou um laudo e orçamento de uma oficina credenciada pelo fabricante do equipamento danificado.

    Depois da vistoria, a concessionária de energia tem mais 15 dias para informar se o pedido será aceito, ou não. Em caso positivo, o consumidor pode ser ressarcido em dinheiro, mediante custeio do conserto ou substituição do equipamento danificado. O prazo para o ressarcimento é de até 20 dias corridos, a partir da data da resposta da empresa.

    A responsabilidade pode não se limitar a isso – mas é preciso apresentar documentos

    O CDC também ampara o consumidor em caso de prejuízos adicionais, como perda de alimentos estragados em decorrência da falta de refrigeração ou até mesmo na ocorrência de danos não materiais ou indiretos (por exemplo, o comprometimento da realização de um trabalho por falta de energia). Nesses casos, devem ser apresentados cálculos, orçamentos, relação de valores dos produtos ou alimentos estragados e todos os demais tipos de demonstrativos e documentos pertinentes, de modo a que se possa comprovar o alegado.
