    Qual é a natureza jurídica de uma startup?

    Resumo:

    O trabalho busca, através do método descritivo-analítico, trazer reflexões sobre o direito das startups, inovação e empreendedorismo no âmbito da transformação digital no contexto de uma economia global. Ainda, faz-se uma interface sobre quem pode ser empreendedor, da governança corporativa e do papel do investidor. As hipóteses de pesquisa procuram investigar as respostas aos seguintes questionamentos: Qual a contribuição do Direito na paisagem dos negócios formados por empresas startups no Brasil? Quais aspectos necessários para a adequação da inovação ao Direito que precisam ser observados para empreender com segurança jurídica? Os procedimentos metodológicos foram baseados em pesquisas documentais, doutrinárias e de revisões bibliográficas. Como resultados alcançados, conclui-se pela necessidade de uma maior regulação do direito e sua interação com as novas tecnologias para prover princípios capazes de tutelar a dinâmica do empreendedorismo digital. A inovação e a governança corporativa são importantes ferramentas de gerenciamento de riscos tanto no mercado tradicional, como no ecossistema do empreendedorismo para propiciar a concretude jurídica da lógica startup que se torna uma forma de ser e estar na economia globalizada.

    Abstract:

    The paper seeks, through the descriptive-analytical method, to bring reflections on the law of startups, innovation and entrepreneurship in the context of digital transformation in the context of a global economy. Also, an interface is made about who can be an entrepreneur, corporate governance and the role of the investor. The research hypotheses seek to investigate the answers to the following questions: What is the contribution of Law in the business landscape formed by startup companies in Brazil? What aspects are necessary for the adequacy of innovation to the Law that need to be observed to undertake with legal certainty? The methodological procedures were based on documental, doctrinal research and bibliographic reviews. As results achieved, it is concluded that there is a need for greater regulation of law and its interaction with new technologies to provide principles capable of protecting the dynamics of digital entrepreneurship. Innovation and corporate governance are important risk management tools both in the traditional market and in the entrepreneurship ecosystem to provide the concreteness of the startup legal logic that becomes a way of being in the globalized economy.

    O que é startups jurídicas?

    O ramo jurídico é um dos mercados mais tradicionais e requisitados do Brasil, e é claro que por ser uma área tão antiga, muito do seu modelo de negócio é considerado mais engessado e um pouco mais travado em relação aos quesitos mais modernos que temos atualmente.

    Na tentativa de se adaptar aos tempos modernos e abraçar o futuro, assim como as indústrias fazem com a máquina envolvedora que ajuda a dar acabamento às peças de máquinas e objetos, no ramo jurídico estão se popularizando as chamadas startups jurídicas.

    Ainda conforme a ABLL o número de startups jurídicas sobe, em média, cerca de 300% ao ano desde 2019, representando o crescimento acelerado desse mercado, muito disso se deve justamente a modernização do ramo da advocacia e da adequação a uma nova realidade na prestação de serviços.

    O que faz uma startup jurídica?

    São inúmeros os serviços prestados por uma startup jurídica, entre os principais, podemos ressaltar o controle de prazos e processos; a disponibilização de advogados online; a automação e gestão de documentos; o monitoramento automatizado e inteligente de informações e a mediação de conflitos.
