    O processo administrativo disciplinar (PAD), como o próprio nome sugere, é um processo administrativo que tem como objetivo apurar transgressões disciplinares dentro da administração direta e indireta, em órgãos públicos. O PAD é um procedimento que ocorre fora do poder judiciário, é meramente administrativo, entretanto, é capaz de apurar infrações, constituir provas e ainda, aplicar penalidades de diversos graus, incluindo a demissão do servidor público.

    Então, em síntese, este procedimento serve para apurar a responsabilidade do servidor público por alguma irregularidade cometida no exercício de seu cargo. Por exemplo: desídia, ocupação de dois cargos públicos simultaneamente, desvio de verbas públicas, etc. Vamos aprofundar melhor agora.

    Embora seja comum estabelecer três etapas no processo administrativo disciplinar, é importante saber que ele possui uma fase prévia chamada de sindicância.

    Todo PAD tem seu início quando ocorre uma denúncia de infração, de forma pública ou anônima. Posteriormente, essa “denúncia” levará a uma sindicância, para apurar a veracidade das informações prestadas e definir a gravidade da infração e se ela é passível ou não de instauração de processo administrativo disciplinar.

    Vale lembrar, que a sindicância ainda não faz parte do PAD, ela se trata apenas de uma investigação preliminar, para ver se vale a pena ou não abrir um processo administrativo.

    Após a sindicância, se tiver atestado que houve uma infração considerada leve ou moderada, é provável que não haja a instauração de um PAD, entretanto, haverá advertência ou suspensão de até 30 dias do servidor público infrator.

    Agora, se a sindicância apurar uma irregularidade grave, um ato ilícito criminoso, o Processo Administrativo Disciplinar é instaurado.

    O Processo Administrativo Disciplinar — PAD é dividido em três etapas:

    1. Fase de Instrução:
    2. Essa etapa é marcada principalmente pela formação de uma comissão que irá acompanhar o PAD. Ela é formada por 3 (três) servidores estáveis, que são designados por uma autoridade competente.

    3. Fase do Inquérito:

A fase do inquérito será onde a comissão terá de recolher depoimentos de testemunhas, colher provas e indícios e realizar as investigações aprofundadas para apurar a infração o máximo possível a fim de responsabilizar o servidor pelo ato ilícito. Lembrando, que essa etapa é de competência da Comissão, ou seja, demais servidores não poderão interferir na apuração.

    5. Fase do Julgamento:
    6. Após a etapa de recolhimento de provas e abertura para defesa, a comissão emitirá um relatório do processo, relatando todo o andamento e tudo que foi juntado ao processo e proferindo algo equiparado a um “parecer” ou mesmo recomendação. Logo após, a autoridade que irá julgar, terá um prazo de 20 (vinte) dias para proferir a decisão final, e ela pode ou não acatar a recomendação formulada pela Comissão, isso normalmente, é muito.

    O que diz a Súmula 611 do STJ?

    Desde que devidamente motivada e com amparo em investigação ou sindicância, é permitida a instauração de processo administrativo disciplinar com base em denúncia anônima, em face do poder-dever de autotutela imposto à Administração.

    Quando um pad pode ser anulado?

    Que para anular o PAD, o servidor tem que mostrar que houve alguma situação, além do excesso de prazo, que traga prejuízo à sua defesa no PAD. Podemos pensar em alguns exemplos comuns que levam à nulidade de PADs na Justiça: Prescrição do Direito de punir o servidor (veja mais abaixo o que isso significa);

    Como reverter processo administrativo disciplinar?

    Ter de enfrentar um processo disciplinar não é uma tarefa fácil. Mas podem ocorrer problemas nessa investigação e, assim, você poderá anular o PAD.

    Isso porque o temido processo administrativo disciplinar nem sempre ocorre da maneira correta, ainda mais quando a investigação não tem fundamento, servindo apenas para perseguição.

    É óbvio que existem investigações com base em possíveis fatos ilícitos que, ao final, são confirmados e devem ser aplicadas as devidas penalidades.

    Porém, a realidade é que boa parte dos processos disciplinares ocorrem em desacordo com as leis. E isso pode gerar nulidade do processo.

    O PAD é um procedimento em que a Administração Pública verifica se aconteceram fatos no exercício da função pública que configuram infração.

    Todos os que trabalham no setor público, em cargos efetivos, ou não, estão sujeitos ao PAD.

    Caso a Administração Pública entenda que houve a infração, podem ser aplicadas as seguintes penalidades ao servidor público:

    • Advertência;
    • Suspensão;
    • Demissão.

    Neste último caso, inclusive, é possível receber a sanção após deixar de exercer as atividades no setor público.

    Porém, o fato que causou a penalidade só poderá retroagir aos últimos cinco anos.

    Portanto, fique atento! Se o fato que causou a penalidade ocorreu há mais de cinco anos, você não pode sofrer qualquer sanção. Isso porque os fatos que ocorreram antes desse prazo estão prescritos, conforme previsto na Lei n.º 8.112/90.

    A seguir, vou te mostrar como identificar os 3 principais erros que podem anular o processo administrativo disciplinar. Confira:

    1. Pode ser que existam erros quanto à forma de apurar a ocorrência de um ato praticado pelo servidor público.
    2. Por exemplo: devia ser aberto um procedimento de sindicância em vez de um PAD, pois o PAD é destinado a apurar somente as condutas mais gravosas.

    Enquanto a sindicância serve para apurar e punir situações que envolvam infrações mais leves por parte do agente público, dividindo-se em duas fases:

    Desse modo, pode existir nulidade quanto à forma ou a escolha do procedimento. Portanto, é possível anular o processo administrativo disciplinar, com base na nulidade formal.

    Afinal, o Poder Público não pode abrir um PAD sem a instauração da devida sindicância. Ela deve ocorrer de forma prévia, para apuração dos fatos que sejam, a princípio, tidos como leves.

    Inclusive, o servidor deve ter a chance de reparar o erro, antes de sofrer uma punição grave, como no caso da demissão ou perda do cargo efetivo.

    A nulidade relativa depende da análise de detalhes do caso, devendo ser informada no momento oportuno. Além disso, deve demonstrar o efetivo prejuízo ao servidor público.

    Por exemplo: digamos que houve a abertura de um PAD que se deu com base na queixa de um inimigo pessoal do acusado.

    Pode ser que a queixa tenha acontecido apenas pela vontade de prejudicar o servidor que está recebendo o PAD. Logo, há uma suposta nulidade, ou seja, ela é relativa.
