    Como pesquisar processos cíveis?

    A tecnologia facilitou a vida de quem precisa consultar o andamento de um processo. Antigamente, era preciso ir até o balcão de atendimento do Fórum e passar por toda uma burocracia. Hoje, a consulta de processo está disponível na internet, por meio dos portais dos Tribunais.

    Mas quem pode acessar os conteúdos dos processos? Pelo Código de Processo Civil, no Artigo 189:

    Os atos processuais são públicos, todavia tramitam em segredo de justiça os processos:

    1. em que o exija o interesse público ou social;
    2. que versem sobre casamento, separação de corpos, divórcio, separação, união estável, filiação, alimentos e guarda de crianças e adolescentes;
    3. em que constem dados protegidos pelo direito constitucional à intimidade;
    4. que versem sobre arbitragem, inclusive sobre cumprimento de carta arbitral, desde que a confidencialidade estipulada na arbitragem seja comprovada perante o juízo.

    Assim, qualquer cidadão pode acessar um dos portais dos Tribunais, como o Portal e-SAJ, e fazer uma consulta de processos. Dos casos que não estão em segredo de Justiça, são exibidas informações como metadados, histórico de movimentações e documentos públicos. Porém, o mesmo artigo limita o acesso aos autos do processo às partes envolvidas. No caso dos portais dos Tribunais, este acesso é fechado por uma senha, que é enviada somente aos advogados das partes.

    O Sistema de Automação da Justiça (SAJ), desenvolvido pela Softplan, é a solução de gestão processual adotada por sete Tribunais. O SAJ é responsável por 43% do estoque de casos pendentes da Justiça Estadual. Esses processos, tanto de 1º quanto de 2º grau, estão disponíveis para consulta no Portal e-SAJ de cada uma das sete Cortes. Na consulta de processos de 1º grau, os usuários podem definir qual a comarca ou foro desejado. Para um resultado mais assertivo, é melhor ter em mãos o número do processo. Mas caso não tenha, você pode fazer a busca por:

    • nome da parte;
    • CPF/CNPJ da parte;
    • OAB do advogado;
    • Número do processo.

    Para os processos de 2º grau, não há opção de escolher a comarca. Nesta consulta, a pesquisa é restrita ao número do processo, nome da parte, documento da parte, nome do advogado e matrícula da OAB.

    O Portal e-SAJ também dá acesso a consultas públicas de Pauta de Audiência, Pauta de Julgamento, Ordem de Processos e Jurisprudência.

    No TJAC, as consultas de 1º e 2º grau são feitas pelo Portal e-SAJ. O link está disponível no site do Tribunal, mas você pode acessá-lo diretamente em: Portal e-SAJ do TJAC

    A consulta de processos do TJAL também é feita pelo Portal e-SAJ tanto no 1º quanto no 2º grau. Acesse: Portal e-SAJ do TJAL

    O TJAM conta com a solução SAJ para gerenciar os processos de 1º e 2º grau das unidades da região metropolitana de Manaus. Para as comarcas do Interior do Estado, o sistema utilizado é o Projudi. Sendo assim, as consultas de processos de 1º grau na Capital e 2º grau são feitas pelo Portal e-SAJ: Portal e-SAJ do TJAM

    E as consultas processuais para o 1º grau nas comarcas do Interior são realizadas no portal do Projudi: Projudi do TJAM

    O TJCE está em processo …

How do I get free advice from California Labor Law? Everyone always mentions employees need more rights, but little attention is placed on what rights employers are violating under California and federal law on a consistent basis. Employee rights are of course more important than ever in this economy. With fewer and fewer small business employing workers in California, big companies seem to have gained leverage and the ability to violate employee rights. One type of employee rights that are often at issue relates to wages and hours. In particular, the issue of labor law breaks has found its way to court in many recent employment law cases. Employees are entitled to a 30 minute uninterrupted meal break for every 30 hours of work performed for the employer. However, what if the employees waives this right to a meal break by signing a meal break waiver? Or what if the employee clocks out for a meal break but continues to work through the break because the company requires the employee to do so? These employee rights are currently hot topics in California employment law and the answers to these questions are uncertain as of now. Another hot topic about employee rights deals with discrimination in the workplace. What happens if a company fires an employee but gives a false reason for the termination? Is this considered a wrongful termination? Does this give rise to a viable claim for discrimination in the workplace? Under California discrimination laws, if employees prove that an employer gave a false reason for firing the employee, this does not necessarily mean that the employee rights were violated by the company. However, the company has to present another reason for why the employee was fired. If this reason is deemed discriminatory, the employee may have a viable discrimination claim. Employee rights relating to working conditions is another current topic in California employment law. In particular, the issue of whether employees are required to stand up for long periods of time without the ability to sit down in a chair. Recently, several lawsuits have been filed against employers who require employees to stand up in the retail industry. Do employee rights entitle the workers to sit down or are the workers required to stand up all day? At Blumenthal, Nordrehaug & Bhowmik, our lawyers have obtained more than $1.3 billion in judgments and settlements for employees and consumers whose rights have been violated by companies of all sizes, with a substantial portion of that amount recovered through class action litigation throughout California.
