    N.M. apresentou documentos que comprovam a ocorrência da subtração do cartão bancário e da fraude. Ele também registrou um Boletim de Ocorrência, no qual noticiou à Autoridade Policial a prática do crime.

    O juiz considerou que as atitudes da C6 Bank violaram as normas previstas no Código de Defesa do Consumidor e a Súmula 297 do STJ. O juiz afirmou que “a ré possui a obrigação de prestar serviço adequado, bem como informar claramente ao consumidor”.
