    A Advocacia-Geral da União (AGU) garante a execução de políticas públicas (conjunto de ações do Estado para o bem coletivo), seja pela defesa judicial ou pelo assessoramento jurídico aos dirigentes do governo federal, sendo responsável pela defesa judicial da União, de suas autarquias e fundações públicas.     A defesa de membros e servidores do órgão assessorado, quanto a atos praticados no exercício de suas atribuições constitucionais, legais ou regulamentares, e no interesse público do órgão assessorado, será realizada pela Advocacia-Geral da União (AGU), nos termos do art. 22 da Lei nº 9.028, de 12 de abril de 1995.

Assim, sua atuação consultiva, ou seja, a orientação jurídica realiza-se apenas para os órgãos do Poder Executivo Federal.

    O PRESIDENTE DA REPÚBLICA Faço saber que o Congresso Nacional decreta e eu sanciono a seguinte lei complementar:

    TÍTULO I
    DAS FUNÇÕES INSTITUCIONAIS E DA COMPOSIÇÃO

    Capítulo I
    Das Funções Institucionais

    Art. 1º – A Advocacia-Geral da União é a instituição que representa a União judicial e extrajudicialmente.

    Parágrafo único. À Advocacia-Geral da União cabem as atividades de consultoria e assessoramento jurídicos ao Poder Executivo, nos termos desta Lei Complementar.

    Capítulo II
    Da Composição

    Art. 2º – A Advocacia-Geral da União compreende:

    • Órgãos de direção superior:
      1. a) o Advogado-Geral da União;
      2. b) a Procuradoria-Geral da União e a da Fazenda Nacional;
      3. c) Consultoria-Geral da União;
      4. d) o Conselho Superior da Advocacia-Geral da União; e
      5. e) a Corregedoria-Geral da Advocacia da União;
    • Órgãos de execução:
      1. a) as Procuradorias Regionais da União e as da Fazenda Nacional e as Procuradorias da União e as da Fazenda Nacional nos Estados e no Distrito Federal e as Procuradorias Seccionais destas;
      2. b) a Consultoria da União, as Consultorias Jurídicas dos Ministérios, da Secretaria-Geral e das demais Secretarias da Presidência da República e do Estado-Maior das Forças Armadas;
    • Órgão de assistência direta e imediata ao Advogado-Geral da União: o Gabinete do Advogado-Geral da União;
    • (VETADO)

    § 1º – Subordinam-se diretamente ao Advogado-Geral da União, além do seu gabinete, a Procuradoria-Geral da União, a Consultoria-Geral da União, a Corregedoria-Geral da Advocacia-Geral da União, a Secretaria de Controle Interno e, técnica e juridicamente, a Procuradoria-Geral da Fazenda Nacional.

    § 2º – As Procuradorias Seccionais, subordinadas às Procuradorias da União e da Fazenda Nacional nos Estados e no Distrito Federal, serão criadas, no interesse do serviço, por proposta do Advogado-Geral da União.

    § 3º – As Procuradorias e Departamentos Jurídicos das autarquias e fundações públicas são órgãos vinculados à Advocacia-Geral da União.

    § 4º – O Advogado-Geral da União é auxiliado por dois Secretários-Gerais: o de Contencioso e o de Consultoria.

    § 5º – São membros da Advocacia-Geral da União: o Advogado-Geral da União, o Procurador-Geral da União, o Procurador-Geral da Fazenda Nacional, o Consultor-Geral da União, o Corregedor-Geral da Advocacia da União, os Secretários-Gerais de Contencioso e de Consultoria, os Procuradores Regionais, os Consultores da União, os Corregedores-Auxiliares, os Procuradores-Chefes, os Consultores Jurídicos, os Procuradores Seccionais, os Advogados da União, os Procuradores da Fazenda Nacional e os Assistentes Jurídicos.

    Salários do cargo de Procurador Federal – Brasil A média salarial do cargo de Procurador Federal (Brasil) é de R$ 105.303 por mês. A remuneração variável do cargo de Procurador Federal nessa localização (Brasil) é de R$ 78.000, variando entre R$ 72.000 e R$ 84.000.

    Como se tornar Advogado-geral da União?

    Em dezembro de 2022 a Advocacia Geral da União publicou três editais com oferta total de 300 vagas. As oportunidades são para a Advocacia Geral da União, Procuradoria-Geral Federal e Fazenda Nacional.

    Para participar desta seleção, os candidatos precisam ter alguns requisitos básicos (iguais para os três editais), são eles:

    • De acordo o edital, são consideradas práticas forense:
    • a) o efetivo exercício da advocacia, na forma da Lei nº 8.906/1994, a abranger a postulação a qualquer órgão do Poder Judiciário, assim como as atividades de consultoria, assessoramento e direção jurídicos, sob inscrição na OAB;
    • b) o exercício de cargo, emprego ou função pública, privativos de bacharel em Direito, sejam efetivos, permanentes ou de confiança;
    • c) o exercício profissional de consultoria, assessoramento ou direção, bem como o desempenho, de cargo, emprego ou função pública de nível superior, com atividades eminentemente jurídicas;
    • d) a efetiva participação no programa de estágio de pós-graduação em Direito nos órgãos da Advocacia-Geral da União ou em programas instituídos nos órgãos especificados na alínea “e” do subitem 10.5 deste edital;
    • e) a comprovação de igual período de estágio regular e supervisionado como estudante do curso de Direito, desde que observada a legislação e os demais atos normativos regedores da hipótese;
    • f) o exercício da função de conciliador junto a tribunais judiciais, juizados especiais, varas especiais, anexos de juizados especiais ou de varas judiciais.
